1.Purpose
These Terms and Conditions of Use ("Terms") define the rules of access and use of the application and website Youoki ("the Service"), a private messaging app designed for families, published by FIBERMS — Samir MRABET, individual entrepreneur (see the legal notice).
2.Acceptance of terms
By creating an account and using Youoki, you accept without reservation these Terms as well as the Privacy Policy. If you do not accept these terms, you cannot use the Service.
3.Service access
The essential features of Youoki (messages, calls, groups, media) are free. Using the service requires creating an account and a compatible device with an internet connection.
Some cosmetic features (exclusive badges, themes, conversation backgrounds) are obtained with Points (see section 9).
4.Minimum age and minors
Youoki is intended for family use and registration is open from the age of 13. By creating an account, you confirm that you are 13 years old or older. Between the ages of 13 and 15 inclusive, use of the Service requires the authorisation of a holder of parental authority, in accordance with article 45 of the French Data Protection Act (loi Informatique et Libertés).
Below the age of 13, an account may only be used under the responsibility of a parent, who links it to their own through Parental controls (section 17).
An account identified as belonging to a minor receives no advertising and cannot stake any Points in a challenge (section 9.3).
The parent or guardian who authorizes a minor to use Youoki is responsible for how it is used.
5.Your account
- You are responsible for the confidentiality of your password and the activity of your account.
- You agree to provide accurate information when registering.
- For security reasons, only one mobile device can be connected at a time to the same account.
- In case of unauthorized use of your account, notify us immediately.
6.Usage rules
By using Youoki, you agree not to:
- harass, threaten, intimidate, or harm others;
- distribute illegal, hateful, violent, or child sexual abuse material;
- impersonate another person;
- send spam or unwanted solicitations;
- attempt to bypass, hack, or disrupt the functioning of the Service;
- use the Service for fraudulent or unauthorized commercial purposes;
- collect other users' data without their consent.
Any breach may result in the suspension or deletion of your account (see section 8).
7.Your content
You remain the owner of the content you publish (messages, photos, videos, documents). You are solely responsible for this content and you guarantee that you have the necessary rights to share it.
You grant us only the technical rights strictly necessary to host and deliver your content to its recipients. Conversations, private and group alike, are end-to-end encrypted as soon as every participant has an encryption key: we then have no access to their content.
Some information remains technically readable by our servers: routing metadata, @ mentions of a member, the captions of media sent in a group, and the content you choose to send to an assistance feature (translation, transcription of a voice message, refereeing of a game). The details are set out in the Privacy Policy.
8.Reporting and moderation
Youoki applies zero tolerance towards unlawful content, hateful content, sexual content involving minors, and harassment.
You can report a message, a piece of content or a user, and block anyone directly from the application (conversation menu, long press on a message, or contact card). A blocked person can no longer contact you, see your online status, or challenge you. You can also write to us at [email protected].
As conversations are end-to-end encrypted, moderation relies on your reports. We review them within 24 hours and, depending on the seriousness, we may remove the content, issue a warning, suspend or delete the account concerned, and cooperate with the competent authorities.
9.Points, shop and challenges
9.1 How Points are earned
Points are earned exclusively through use of the application, never in exchange for a payment: welcome bonus when the account is activated, automatic badges, weekly goals, referral of friends and family who become active, and challenge winnings (9.3). Earnings are capped and may be recalibrated to preserve the balance of the Service; we will inform you of this in the application.
9.2 Shop and marketplace
Points allow you to obtain cosmetic items (badges, themes, conversation backgrounds, decorations) linked to your account and with no value outside the Service. Certain badges obtained in the shop can be given to a friend or put back into circulation on the internal marketplace, subject to a withholding of 10 % of the Points, which goes to the Youoki Bank. Items obtained free of charge, pinned, or given with a lock cannot be transferred.
9.3 Challenges with a Points stake
In duel games, two friends can agree on a Points stake (500 Points maximum per game, within the limit of each player's balance). Both stakes are placed in escrow when the challenge is accepted; the winner receives the whole amount. In the event of a draw, a cancellation or a technical failure, each player is refunded. A player who gives up or permanently leaves the game is declared the loser after a grace period.
9.4 Loss of Points
If your account is deleted, or if the Service closes down, your Points balance and the associated items are permanently lost, without compensation. In the event of fraud (multiple accounts, self-referral, manipulation of games), we may cancel winnings or suspend the account concerned.
10.Free service
Youoki is free, without advertising and without any sale of data. There is currently neither in-app purchase nor subscription. Cosmetic items (badges, themes, conversation backgrounds) are obtained exclusively with Points earned by using the application.
Should this model change, you will be informed in the application at least 30 days in advance. You will then be able to export your data and delete your account if this change does not suit you. No amount will ever be charged to you without your explicit and prior consent.
11.Service availability
We strive to ensure continuous operation of Youoki, but do not guarantee absolute availability. The Service may be temporarily interrupted for maintenance, updates, or due to technical constraints beyond our control.
12.Liability
The Service is provided with the reasonable care of a professional. Within the limits permitted by law, the publisher cannot be held liable for the content exchanged between users, for damage resulting from use that does not comply with these Terms, nor for the acts of a third party.
End-to-end encryption makes it impossible to recover your messages without your password: the loss of history following a password reset is inherent to the way the Service works.
Nothing in these terms limits the rights guaranteed to you by law as a consumer.
13.Intellectual property
The "Youoki" brand, logo, interface, graphic elements and Service code are the exclusive property of the publisher. These Terms only grant you a personal and non-exclusive right to use the Service.
14.Termination
You can stop using Youoki and delete your account at any time from Settings → Privacy → Delete my account. This operation is irreversible.
We may suspend or terminate your access in case of violation of these Terms, or if the law requires it.
15.Modification of terms
These Terms may be modified to reflect the evolution of the Service or regulations. The date of last update appears at the top of the page. In case of significant modification, you will be informed via the application.
16.Applicable law and disputes
These Terms are governed by French law. In case of dispute, and failing amicable resolution, you can have recourse to a consumer mediator free of charge. Failing that, French courts have jurisdiction.
17.Parental controls
A parent can ask to link their child's account to their own. The link only takes effect once it has been accepted in the child's application. On that occasion the parent enters the child's year of birth, which is used solely to establish whether the account belongs to a minor.
Depending on their settings, the parent can:
- see the child's live location and location history;
- define safe zones and be alerted when the child enters or leaves them;
- see the state of the device (battery, connection);
- consult an activity log (last connection, time spent, services opened);
- restrict access to certain modules;
- receive an SOS alert together with the location.
Tracking data is kept for 30 days and deleted as soon as the link is removed. The parent undertakes to use these tools only in respect of a child over whom they hold parental authority.
